Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Orbitra Home mobile application (“App”) or related website (collectively, the “Service”), you agree to be legally bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use the Service.

Orbitra Home is a consumer (B2C) service intended for personal, non-commercial household use.

2. Description of Service

Orbitra Home is an AI-powered family productivity application that:

  • Connects to Google Gmail and Google Calendar via authorised API access
  • Processes emails and attachments
  • Generates tasks, reminders, and calendar entries
  • Provides AI-generated daily digests
  • Offers conversational AI assistance
  • Allows users to forward emails to a unique @inbox.orbitrahome.com address assigned to your account
  • Supports family member profiles under a primary account

The Service is initially available on Android devices via Google Play. Future expansion to iOS or other platforms may occur.

3. Eligibility & Accounts

3.1 Primary Account Holders

To create an account, you must:

  • Be at least 18 years old
  • Have a valid Google account
  • Provide accurate registration information

You are responsible for maintaining the confidentiality of your login credentials and device PIN.

3.2 Child & Family Member Accounts (Ages 13+)

  • Child users must be at least 13 years old.
  • Child profiles are created and managed by a parent or guardian (Primary Account Holder).
  • Child access is permission-scoped (e.g., view tasks, create tasks).

By creating a child profile, the Primary Account Holder confirms:

  • They are the legal parent or guardian.
  • They consent to the processing of the child's data.
  • They accept responsibility for supervising the child's use of the Service.

Child accounts may store:

  • Name
  • Tasks
  • Emails and attachments intentionally forwarded
  • Associated AI-generated outputs

The Primary Account Holder may:

  • Modify permissions
  • View child activity
  • Delete child accounts at any time

4. Subscription & Payment Terms

4.1 Billing Platform

All subscriptions are processed exclusively via Google Play Billing. Orbitra Home does not directly process or store payment card details.

4.2 Subscription Pricing

The Service is offered at £9.99 per month (or local equivalent pricing as determined by Google Play in applicable regions). Pricing localisation is standard practice on Google Play.

4.3 Free Trial

New users may receive a 7-day free trial. After the trial period, subscription billing begins automatically unless cancelled.

4.4 Renewals

Subscriptions renew automatically unless cancelled through the Google Play Store prior to the renewal date.

4.5 Cancellation

You may cancel at any time via Google Play subscription settings. Cancellation takes effect at the end of the current billing cycle.

4.6 Refunds

Refunds are governed by Google Play's refund policies. Orbitra Home does not independently issue refunds outside the Google Play system unless legally required.

5. Email Access & Forwarding

The Service processes email content in two ways:

  1. Via authorised Gmail API access (label-based reading system)
  2. Via a unique @inbox.orbitrahome.com forwarding address assigned to your account

Forwarded emails are:

  • Received
  • Stored
  • Parsed
  • Processed by AI systems
  • Retained until deletion by the user or account closure

Raw email bodies and attachments are stored indefinitely while the account remains active.

6. AI Processing & Automated Decision-Making

6.1 Third-Party AI Providers

Email content, attachments, chat inputs, and related data may be transmitted to third-party AI providers including:

  • Google (Gemini models)
  • OpenAI

These providers may process data outside the UK and EU. Standard API usage is applied (not zero-retention mode).

6.2 Automated Task Creation

Orbitra Home uses AI systems that may:

  • Autonomously generate tasks
  • Suggest reminders
  • Extract structured data
  • Create calendar entries

AI outputs are automated and may be inaccurate. You are responsible for reviewing and confirming AI-generated content.

6.3 No Professional Advice

The Service does not provide:

  • Legal advice
  • Financial advice
  • Medical advice
  • Emergency or safety-critical services

Orbitra Home must not be relied upon for life-critical scheduling.

7. Data Retention & Account Deletion

7.1 Active Accounts

While active, the Service stores:

  • Raw emails
  • Attachments
  • AI-generated outputs
  • Tasks and metadata

7.2 Account Deletion

When a user selects “Delete Account”:

  • All associated data is immediately deleted from active systems.
  • Residual backup data may persist for up to 30 days before permanent deletion.

Closed accounts are permanently deleted within 30 days.

8. Data Export & GDPR Rights

Users may request data export by emailing Hello@OrbitraHome.com. Export requests will be fulfilled within 30 days in accordance with UK GDPR. Data portability is currently handled manually.

9. International Data Transfers

Data may be processed outside the UK. Where required, international transfers rely on:

  • UK International Data Transfer Agreements
  • Standard Contractual Clauses (SCCs)
  • Other legally recognised safeguards

10. Acceptable Use

You agree not to:

  • Use the Service unlawfully
  • Attempt unauthorised system access
  • Reverse engineer the software
  • Share credentials outside your household
  • Interfere with Service functionality

11. Intellectual Property

All Service content, code, and branding are owned by Orbitra Home. Users retain ownership of their email content and submitted data.

By using the Service, you grant Orbitra Home a limited, non-exclusive licence to process, store, and analyse your data solely for operating the Service.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We do not guarantee:

  • Continuous uptime
  • Error-free performance
  • AI output accuracy
  • Compatibility with all devices

13. Limitation of Liability

To the maximum extent permitted by law, Orbitra Home's total liability arising out of or related to the Service shall not exceed the total subscription fees paid by you in the preceding 12 months.

We are not liable for:

  • Indirect or consequential loss
  • Data loss
  • Missed events
  • AI-generated inaccuracies
  • Third-party API changes (e.g., Google)

Nothing excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud
  • Any liability that cannot be excluded under English law

14. Indemnification

You agree to indemnify and hold harmless Orbitra Home from claims arising out of:

  • Your misuse of the Service
  • Your breach of these Terms
  • Unlawful content you submit

15. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.

16. Changes to Terms

We may update these Terms. Material changes will be communicated at least 30 days in advance via:

  • Email
  • In-app notification

Continued use constitutes acceptance.
